Commonhold law (WEG law)

Advice on commonhold law for owners, commonhold associations, real estate companies and property management companies – from the declaration of division to representation in court.

WEG law for commonhold associations, individual owners and property management companies.

Where a building consists of several legally self-contained flats that “belong” to different owners, this is referred to as a commonhold association (WEG). Commonhold ownership brings particular legal and economic challenges. Differing interests within a commonhold association, questions about the administration of the common property or disputes over costs and maintenance measures can make decisions more difficult and lead to long-term conflicts.

Whether you are already part of a commonhold association or want to divide a building into commonhold units, we will be glad to support you.

SKNvonGEYSO advises unit owners, commonhold associations, real estate companies and property management companies on all important questions of commonhold law.

Our aim is to make legal relationships understandable, to develop workable solutions and to lay the foundation for transparent and proper administration.

We advise and represent you in particular on:

  • drafting and reviewing a tailored declaration of division when you construct a building or divide an existing building into commonhold units
  • questions concerning the division plan and the distinction between separate property and common property
  • ongoing advice to unit owners and commonhold associations
  • legal support for property management companies
  • enforcing your claims in the context of proper administration
  • structural alterations and maintenance measures
  • the allocation of costs and obligations within the association
  • enforcing claims of individual owners or of the association
  • challenging resolutions that are not consistent with proper administration
  • out-of-court and court representation

Frequently asked questions about commonhold law

Answers to the questions owners and property management companies ask us most often.

What can I do about a defective resolution of the owners' meeting?

Whether and how a resolution can be challenged depends, among other things, on the content of the resolution, the voting procedure and the applicable deadlines. Have the documents reviewed as early as possible, as special deadlines may apply to court action.

We want to divide a building into commonhold units. What do we need?

A declaration of division together with a division plan. We draft or review them on a tailored basis, whether you are constructing a new building or, as owner, want to divide an existing building.

We are a property management company. Do you advise us too?

Yes. Legal support for property management companies is our “daily bread and butter”.
