Tax law

Tax law is complex. Our job is to make dealing with it simple for you.

Tax advice for companies and private individuals in the Hamburg Metropolitan Area.

German tax law cannot be summed up in a few lines. The taxation procedure is governed by the Fiscal Code, whereas the actual amount of tax owed is determined by a large number of individual statutes. What counts for you in the end is not the number of provisions, but a clear, legally sound and economically sensible solution for your specific situation. This is exactly where we support you. As a multidisciplinary partnership of lawyers, tax advisers and certified public accountants, we can directly involve the relevant specialist lawyers wherever tax issues meet legal questions. You will have fixed contact persons. We advise companies of various legal forms and sizes as well as private individuals with more complex tax issues, for example in connection with the succession of assets, real estate ownership or cross-border matters.

What we do for you

  • Ongoing tax advice: We support you on an ongoing basis with tax issues in the business and private sphere, from the classification of individual transactions to the tax assessment of major decisions.
  • Tax planning advice: in restructurings, investments, succession or contracts, we review the tax consequences at an early stage, before contracts are signed or structures are implemented.
  • Binding rulings and wage tax rulings: where the legal position is uncertain, we obtain them for you from the tax authorities so that you have planning certainty before you act.
  • Objection and court proceedings: If you disagree with a tax assessment notice, we assess the prospects of success and represent you in the objection proceedings as well as before the fiscal court and the Federal Fiscal Court.
  • Second opinions and expert opinions: In complex or contentious matters, we prepare written opinions, for example to support decisions vis-à-vis shareholders, banks or your own accounting department.

Specialised topics

For individual areas, we have compiled separate, more detailed information:

  • Tax audit – support with external tax audits of all kinds
  • International tax law – cross-border matters
  • Tax returns – ongoing filing obligations
  • Criminal tax law – where there are risks under criminal or administrative offence law
  • Tax defence advice – in disputes with the tax authorities that are already under way

Frequently asked questions about tax law

Answers to the questions our clients ask us most often.

Should I seek tax advice before or after a decision?

Before the decision, if possible. The tax effects of restructurings, investment decisions, succession planning or contract drafting can only be shaped before contracts are signed or structures are implemented. Early coordination gives you planning certainty before you act.

What can I do about an incorrect tax assessment notice?

An objection can be filed within one month of notification of the assessment notice. The deadline is short and runs regardless of how obvious the error is. We review the notice, file an objection in time to meet the deadline and, if necessary, represent you before the fiscal court.

What is a binding ruling and when does it help me?

A binding ruling is a written commitment by the tax office on how a planned set of facts will be treated for tax purposes. It is subject to a fee and is worthwhile where there are significant legal uncertainties, for example in a restructuring or succession planning. The prerequisite is that the planned transaction has not yet been implemented.

Do you also advise private individuals and not just companies?

Yes. We are happy to advise you, for example, on the succession of assets or real estate investments and to assist you with filing your tax return.

How much does tax advice cost?

Our fees are generally based on the Tax Advisers' Remuneration Ordinance. For more extensive advice, we charge on the basis of a flat fee agreed in advance or on the basis of the hours worked. For recurring services, we usually agree a flat fee so that you can plan.
