IT and Internet law

We support you on all questions relating to the use of the Internet, so that you can make your online presence legally secure.

IT law, e-commerce and digital contracts for companies in Hamburg.

For many, using the Internet is as natural as getting up in the morning, and for companies it is often an important, if not the most important, part of their business. Even before their own company website goes live, companies should therefore make a point of engaging with IT law and ensure that all legal requirements are met. Has the requirement to include legal information been complied with? Are the general terms and conditions (T&Cs) and the notice on the right of withdrawal worded in accordance with the regulations and, above all, legally watertight?

Numerous “sample wordings” can, of course, be found on the Internet. But these do not always stand up to legal scrutiny. Here too, companies are therefore strongly advised to have their own legal information, T&Cs and withdrawal clause reviewed beforehand, or while business is already being transacted, to ensure that they are up to date. It is not uncommon for these issues to be used by competitors as an opportunity to have warning letters issued by their lawyers, with the costs this entails.

IT law covers a great deal more

Closely associated with industrial property rights, copyright and media law, and sometimes also employment law or banking and capital markets law, are data protection law, domain law or, to put it in a nutshell, simply everything to do with computers, software and the Internet.

We also have many years of experience in these areas and will be happy to advise you, on a multidisciplinary basis where necessary, on the following topics, inter alia:

What we do for you

  • Drafting of IT contracts (for example: software licence agreements, software distribution agreements, support and maintenance agreements)
  • Legal issues relating to artificial intelligence
  • Legal support for software implementation projects, open source software
  • E-commerce law: design of online shops, affiliate marketing
  • Domain agreements and disputes
  • Review of your legal information, your T&Cs, etc.
  • Defence against warning letters, for example for unauthorised music in Reels on TikTok or Instagram
  • Data protection law

Data protection in particular has been a recurring topic in the media since the introduction of the EU General Data Protection Regulation (GDPR) in 2018 and is of immense importance for companies. This is because severe penalties can be incurred for non-compliance with the Regulation, and these can be prevented at a comparatively low financial cost by means of a review conducted by experts. We therefore regularly advise our clients: take this topic seriously too and rely on our expert advice, so that you can then return, with a comfortable feeling of security, to what is important to you: your business!

Frequently asked questions about IT and Internet law

Answers to the questions our clients ask us most often about digital business.

Are free T&C templates enough for my online shop?

Numerous sample wordings can be found on the Internet. But these do not always stand up to legal scrutiny. We therefore strongly advise companies to have their own legal information, T&Cs and withdrawal clause reviewed beforehand, or while business is already being transacted, to ensure that they are up to date.

What happens if the legal information, T&Cs or withdrawal clause do not comply with the regulations?

It is not uncommon for these issues to be used by competitors as an opportunity to have warning letters issued by their lawyers, with the costs this entails. Even before their own company website goes live, companies should therefore ensure that all legal requirements are met.

Which software-related contracts do you draft?

We draft IT contracts, for example software licence agreements, software distribution agreements and support and maintenance agreements. We also provide legal support for software implementation projects and the use of open source software, on a multidisciplinary basis where necessary. We also advise on outsourcing projects, on both the provider and the customer side.
