Tenancy law

Tenancy law advice for companies, landlords, owners and property management companies, from drafting the agreement to enforcing your claims in court.

Residential and commercial tenancy law for landlords and tenants in Hamburg.

Thorough legal advice is highly relevant not only when it comes to “acquiring” and “building”. Tenancies are often long-term and of considerable economic importance. Unclear contractual provisions, unpaid rent, disputes over service charges or defects can quickly lead to conflicts.

SKNvonGEYSO advises companies, owners, property companies, property management companies and institutional landlords on all key issues of tenancy law.

Among other things, we advise and represent you on:

  • drafting, reviewing and negotiating lease agreements
  • commercial lease agreements and agreements on larger properties
  • legal support during ongoing tenancies
  • questions on rent, rent adjustments and service charges
  • defects, maintenance and modernisation measures
  • late payment and other breaches of duty
  • notices of termination and the ending of tenancies
  • preparing and enforcing eviction claims
  • enforcing your claims out of court and in court

We attach great importance to clear and comprehensible communication. You should understand at all times how the legal situation is to be assessed, what options are available and which steps make sense.

Frequently asked questions about tenancy law

Answers to the questions our clients ask us most often about tenancy law.

When should I have a lease agreement legally reviewed?

Ideally before signing. An early review can help to identify unclear provisions, economic risks and future points of dispute. A review can also be useful for existing agreements if the use, the parties or the legal framework have changed.

What can I do if my tenant does not pay?

That depends, among other things, on the amount and duration of the payment arrears and on what has been agreed in the contract. We examine the situation and explain whether a payment reminder, a formal warning, a notice of termination or other action should be considered first.

Who is responsible for repairs and maintenance?

That depends on the statutory rules and the specific lease agreement. Not every contractual provision is valid or unambiguous. It can therefore be important to review the agreement and the actual circumstances.

Can I terminate a tenancy because the tenant has breached the agreement?

As a rule, termination requires certain legal conditions to be met. Depending on the situation, rent arrears, serious breaches of duty or the fact that continuing the tenancy can no longer reasonably be expected may be relevant, among other things. The legal position should be examined carefully before giving notice of termination.
